Item No. 7 R <br /> Staff Report No. <br /> Meeting Date: June 8, 1998 <br /> Type of Business: CB <br /> WK: Work Session;PH:Public Hearing; <br /> CA:Consent Agenda;CB:Council Business <br /> City of Mounds View Staff Report <br /> To: Honorable Mayor and City Council <br /> From: Jim Ericson, Planning Associate <br /> Item Title/Subject: Public Hearing and Consideration of Resolution No. 5241, a <br /> Resolution Approving a Conditional Use Permit for a Residential <br /> Dog Kennel at 2359 Pinewood Circle;Planning Case No. 528-98. <br /> Date of Report: June 4, 1998 <br /> Background: <br /> The applicants, Scott and Marcia Dumonceaux of 2359 Pinewood Circle, are applying for a <br /> conditional use permit for a residential dog kennel, a Code requirement for property owners with <br /> three or four dogs. One of the licensing requirements is that the property owner shall obtain <br /> signatures of approval from more than 50 percent of the residents within 500 feet of the property <br /> proposing the kennel. The applicants were sent a map showing those properties within 500 feet <br /> along with a corresponding list of property owners/taxpayers. This has been accomplished. <br /> The Planning Commission, at its meeting on May 20, 1998, voted unanimously to approve a <br /> resolution recommending approval of this CUP request to the City Council. Planning <br /> Commission Resolution No. 550-98 is attached for Council review. <br /> Discussion: <br /> Petition: On the map the staff sent to the applicants, 56 properties were highlighted, which means <br /> that 29 of the property owners would need to sign the petition, which was also provided by staff. <br /> The applicants collected 30 signatures approving of the kennel request. All of the properties <br /> adjacent to 2359 Pinewood Circle, of which there are five, have indicated their approval of the <br /> application. <br /> Background Check: Staff requested the Police Department to check its records with regard to <br /> animal complaints at this location. Only two incidences are on record for this address, one <br /> occurring in March of 1997 and the other more recently in May of 1998. The 1997 incidence, <br /> which the applicants take full responsibility for, resulted from them leaving for the weekend with <br /> the dogs in the care of a"babysitter". The babysitter was not at the house when the applicants left <br /> and did not spend the entire day at the home, leaving one dog outside unattended. The applicants <br /> regret the inconvenience this cause their neighbors and have not had any complaints since then <br /> about barking dogs. The 1998 complaint simply was for owning four dogs without a kennel <br /> license/CUP, not for barking dogs. <br />
