The proposed amendment is to substitute Mounds View <br /> Family Housing Limited Partnership as the developer in the place of MSP Real Estate, Inc. and <br /> Mounds View Family Housing LLC. A copy of the amendment drafted by the City Attorney's <br /> office is attached for your consideration. <br /> The current agreement in Section 3.05 states that"the Developer may not assign any of its <br /> obligations under this Agreement without prior written consent of the City." <br /> RECOMMENDATION: Staff recommends that the City Council approve Resolution No. 5258 <br /> approving the attached First Amendment to the Developers Agreement between the City and <br /> MSP Real Estate, Inc. and Mounds View Family Housing LLC and authorize the Mayor and <br /> Acting City Administrator to execute the document on behalf of the City. <br /> Rick Jopke, Co munity Development Director • <br /> C:\OFFICE\WPWIN\WPDOCS\81098STA.RPT <br />
