Pinkerton) desire to be <br /> bound by such substitution of the party now constituting the Developer. <br /> WHEREAS, pursuant to Section 3.0.5 of the Agreement executed by the <br /> City of Mounds View, MSP Real Estate, Inc. and Mounds View Family Housing <br /> LLC, "the Developer may not assign any of its obligations under this Agreement <br /> without the prior written consent of the City." <br /> WHEREAS,the City consents to the assignment of the obligations and the <br /> substitution of the party now constituting the Developer as set forth herein. <br /> NOW, THEREFORE, in consideration of the mutual covenants and obligations <br /> herein contained,the Agreement is hereby amended in the following respects. <br /> I. The preamble paragraph of the Agreement is amended to read as follows: <br /> THIS AGREEMENT is made this 11th day of February, 1998 by and <br /> between the CITY OF MOUNDS VIEW, a Minnesota municipal corporation (the <br /> "City"), and MOUNDS VIEW FAMILY HOUSING LIMITED PARTNERSHIP, a <br /> Minnesota limited partnership (the "Developer"). <br /> II. Paragraph A of the Recital section of the Agreement is modified to read as <br /> follows: <br /> A. The Developer is the fee owner of certain real estate located in <br /> Ramsey County, Minnesota,legally described as: <br /> Lots 79 and 80 Spring Lake Park Hillview, Section 6,Township 30, <br /> Range 23,Ramsey County,Minnesota. <br /> (Hereinafter referred to as the `Property"). <br /> SJR-147930 2 <br /> MU210-17 <br />
