and Code Section 502.04, Subd. 2.c. and Code Section 503.04. Subd. 2.c. & d., as to
• licensing restrictions. may also have to be addressed.
As an alternative to the above noted options. Code Section 502.03. Subd. 7 provides for the
issuance of a temporary intoxicating liquor banquet license, which can be issued to a holder of
an on-sale intoxicating liquor license issued by the City or an adjacent city.. subject to the
requirements(similar to those contained in the above referenced code sections)of the subdivision.
as well as the requirements of Minn. Stat. § 340A.404, Subd. 4(a). Additionally, a new
Municipal Code section could also be created to encompass the authority contained in Minn. Stat.
§ 340A.404. Subd. 4(b) as to a retail on-sale intoxicating liquor licensee's ability to make off
premise sales at a community festival. It should be determined if either Code Section 502.03.
Subd. 7 or the new Minn. Stat.. § 340A.404, Subd. 4(b) are viable alternatives to the above noted
license options.
In addition to the necessary code changes, another issue the City should review is whether or not
the event sponsor and the City have appropriate levels of liability insurance to cover such an
event (does the City's policy cover such an event etc.). Sec Minn. Stat. § 340A.409.
For your reference I have enclosed the above noted statutes.
