UNApPROVED <br /> . Page 3 <br /> March 9, 1998 <br /> Mounds View City Council <br /> 1 dedicate a portion of land for public purposes or a cash dedication in lieu of land. The dedication amount <br /> 2 would be$68,400 for this development. Mr.Ericson noted that the final plat has been reviewed by <br /> 3 Ramsey County and approved except for one technicality which is expected to be resolved. Additionally, <br /> 4 the City Engineer,Director of Public Works and the Rice Creek Watershed District have reviewed it and <br /> 5 found it acceptable. <br /> 6 <br /> 7 Mr. Ericson noted a minor change to Resolution No. 5212. The 9th and 10th WHEREAS clauses should <br /> 8 be removed from the resolution. Stipulation 5. should be added to read 5. Consider transfer of liquor license from Donatelle's Inc.(Edward Donatelle)to 2400 Highway <br /> 11) 20 10,Inc.(Jeffrey Weyek)-expires 6/30/98. <br /> 21 3. Consider issuance of an amusement center license and associated amusement devices licenses- <br /> 22 expires 12/31/98. <br /> 23 4. Consider issuance of a restaurant license-expires 12/31/98. <br /> 24 <br /> 25 Mayor McCarty opened the Public Hearing at 7:29 p.m. <br /> 26 <br /> 27 Mr. Kessel,Finance Director,explained that there have been a number of comments made by residents <br /> 28 with regard to this transfer. Concerns addressed include the location of the garbage containers,the <br /> 29 incinerator on the property and the parking situation. <br /> 30 <br /> 31 Mr. Jopke noted that he is unable to find anything in the ordinance that would require that these concerns <br /> 32 be addressed before the transfer can be made. However,the concerns will be addressed under the city <br /> 33 code. <br /> 34 <br /> 35 Pat Michna,5287 Edgewood Drive, stated there have been many complaints of accidents in the area due to <br /> 36 lack of driveway or entrances/exits from the street. She is also concerned about the garbage containers <br /> 37 which she feels are inadequate for the type of business. Other concerns she addressed were the junk and <br /> 38 debris at the rear of the property(she is not sure if this is part of the Donatelle property), whether or not <br /> 39 there are sufficient parking spaces for the business,and the incinerator on the property. <br /> 40 <br /> 41 Attorney Reeds explained that these issues deal with code enforcement and that the transfer of the liquor <br /> 42 license cannot be denied because of the concerns addressed. <br /> 43 <br /> 44 Mr.Jopke noted that the entrance/exits will be taken into consideration at time of street reconstruction <br /> . 45 which is expected to take place within the next two to three years. In regard to adequate parking,Mr. <br /> 46 Jopke stated he was unable to respond but would check on it to be sure it is in code compliance. <br /> 47 <br />
