not exceed fifty (50) percent of the market value of the structure unless the conditions of <br /> this Section are satisfied. The cost of all structural alterations and additions constructed <br /> since the adoption of the City's initial flood plain controls must be calculated into today's <br /> current costs which will include all costs such as construction materials and a reasonable <br /> cost placed on all manpower or labor. If the current cost of all previous and proposed <br /> alterations and additions exceed fifty(50) percent of the current market value of the <br /> structure, then the structure must meet the standards of this ordinance for new structures. <br /> Section 13. Section 1301.13 Subd. 8 is hereby amended to read as follows: <br /> Subd.8. The Zoning Administrator shall prepare a list of those nonconforming uses which <br /> have been floodproofed or otherwise adequately protected in conformity with <br /> • .. • - •• Section 1301.12 Subd. 7 of this Chapter. He shall present <br /> such list to the City Council which may issue a certificate to the owner stating that <br /> such uses, as a result of these corrective measures, are in conformity with the <br /> provision of this Chapter. (Ord. 535, 3-14-94) <br /> Section 14. Section 1301.14 Subd. 3 is hereby amended to read as follows: <br /> Subd. 3. Removal of Special Flood Hazard Area Designation: The Federal Emergency <br /> Management (FEMA) has established criteria for removing the special flood <br /> hazard area designation for certain structures properly elevated on fill above the <br /> • 100-year flood elevation. FEMA's requirements incorporate specific fill <br /> compaction and side slope protection standards for multi-structure or multi-lot <br /> developments. These standards should be investigated prior to the initiation of site <br /> preparation if a change of special flood hazard area designation will be requested. <br /> (Ord. 535, 3-14-94) <br /> Section 15. Section 1301.15 Subd. 2 is hereby amended to read as follows: <br /> Subd. 2. Public Transportation Facilities: Railroad tracks, roads and bridges to be located <br /> within the F.Z.D. shall comply with . ..'•' •. ..: . . . <br /> Section 1301.10 Subd. 2.c(1) and (2) of this Chapter. Elevation to the regulatory <br /> flood protection elevation shall be provided where failure or interruption of these <br /> transportation facilities are essential to the orderly functioning of the area. Minor <br /> or auxiliary roads or railroads may be constructed at a lower elevation where <br /> failure or interruption or transportation services would not endanger the public <br /> health or safety.
