Mayor and City Council <br /> Mobile Home Park Closing Ordinance <br /> November 4, 1996 <br /> Page 3 <br /> • Criminal: RamseyCountywrites a citation, like a traffic ticket, charging the license holder with a <br /> violation. If they fail to correct the violation and they are convicted in court, the license holder is <br /> guilty of a misdemeanor. <br /> 3. Administrative: Ramsey County takes action against the license, either to suspend, revoke or deny <br /> renewal. <br /> Of all of the licensing responsibilities of the County Health Department, which include restaurants, <br /> campgrounds, hotels and motels, etc, mobile home parks are the only facility where people live on a permanent <br /> basis. As a result, the County Health Department acts with caution in dealing with suspension, revocation and <br /> denial of licenses. If a license is suspended, revoked or denied, it would mean closure of the park and eviction <br /> of the residents. The primary focus of the County Health Department in inspecting mobile home parks is <br /> health and sanitation issues. <br /> Town's Edge Terrace has a license in place, and is expected to be issued a license for 1997. <br /> Mounds View Regulations: <br /> The City of Mounds View has regulations which apply to mobile home parks, including the R-5 Zoning <br /> District (Chapter 1110), the Housing Code(1005), and the Building Codes. According to Section 1110.06 <br /> Subd. 4d in the R-5 District regulations, "Mobile or manufactured homes shall not be used for residential <br /> Orposes if they: <br /> • Do not conform to the requirements of the Vehicle Code of the State. <br /> • Are in an unsanitary condition or have an exterior in bad repair. <br /> • Are structurally unsound and do not protect the inhabitants against all elements. <br /> • Do not conform to the requirements of the Chapter 1005, Housing Code, of this Municipal Code." <br /> In addition, Section 327.26 Subd. 2 of the Minnesota State Statutes states"Any municipality which enacts or <br /> has enacted laws or ordinances relating to the safety and protection of persons and property is empowered to <br /> enforce the laws or ordinances within any manufactured home park...notwithstanding the fact that the <br /> park...may constitute private property. <br /> Based on these two provisions, City Attorney Bob Long has determined that the City's Housing Code applies <br /> to the individual homes in the mobile home parks in Mounds View. It has not been the practice of the City to <br /> enforce the Housing Code in the mobile home parks in the past. Present day staff does not know why this <br /> practice has been followed. If the City Council desires staff to enforce the Housing Code in the mobile home <br /> parks on individual homes, it will have a significant impact on staff workload and will need to be phased. <br /> Staff is enforcing the Building Code requirements for how mobile homes are installed and hooked to utilities. <br /> SR ,,AL 7 --____ <br /> Pamela Sheldon, Community Development Director <br />
