• <br /> MEMORANDUM <br /> TO: Jim Thomson, City Attorney <br /> FROM: Jennifer Bergman, Housing Inspector <br /> DATE: April 3, 1995 <br /> SUBJECT: Manufactured Home Park Closing Ordinance <br /> Attached is a draft copy of the Manufactured Home Park Closing Ordinance. Prior to <br /> drafting the ordinance, I reviewed Minnesota State Statute 327C.095 on park closings <br /> and the City of Bloomington's ordinance. This ordinance is basically copied verbatim <br /> from the City of Bloomington with very few changes. <br /> To assist in the drafting of the ordinance, a task force was formed. Overall, the task <br /> force felt that the ordinance was too vague. Listed below are their suggestions. I am <br /> not sure, legally, what can or cannot be stated in the ordinance. <br /> • 1110.14 Subd. 1. & Subd. 1.a.: Can the park owner be responsible for a <br /> percentage of the relocation costs instead of the total amount? <br /> • 1110.14 Subd. 1. a.: Hook-up charges are too vague, can there be a <br /> maximum amount attached? <br /> • 1110.14 Subd. 1. b.: Shouldn't the mover of the manufacture home, not <br /> • <br /> the park owner, be responsible for the insurance? <br /> • 1110.15 Subd. 1.: The task force wanted the ordinance to state that the <br /> home owner must first provide proof that they can't move their home in <br /> order to be eligible to leave their home there and receive market value. <br /> • 1110.15 Subd. 1.: Is it possible to obtain either the estimated market <br /> value of the manufactured home from either the County Assessor or a <br /> private inspector? <br /> • 1110.15 Subd. 3.: It's the task force's feeling that 20% is too high. <br /> • What if the park is closed for some other reason besides sale of the <br /> property or conversion to another use? <br /> Thank you for your assistance. <br /> • <br />
