The Mounds View Zoning Code allows for certain non-residential uses to be <br /> developed in residential districts with the approval of a conditional use permit. These uses include: <br /> Public or semi-public recreational buildings and neighborhood or community centers,public and private <br /> educational institutions limited to elementary,junior high and senior high schools and religious institutions such as <br /> churches,chapels,temples and synagogue. <br /> • Governmental and public utility buildings and structures necessary for the health,safety and general welfare of the <br /> community. <br /> • Day care,group nursery. <br /> • Nursing homes and similar group housing but not including hospitals, sanitariums or similar institutions. <br /> • Parking facilities for adjacent commercial...establishments. <br /> These uses differ from single family residential uses in that they have parking lots. The current setback <br /> requirement for parking lots is five feet from property lines. During the discussions on the New Apostolic <br /> Church, which was proposed on property at 3025 County Road H, it became apparent that citizens feel five <br /> feet is not sufficient to provide adequate buffering between parking lots and residences, and that having a <br /> parking lot that close to their property has a detrimental effect on the residential character of the <br /> neighborhood. <br /> Preparation of this ordinance was prompted by a request from Mr. Danny D. Moon, 6929 Pleasant View <br /> Drive, that the Zoning Code be amended to require a minimum 15 foot setback between parking lots and <br /> property lines, when the parking lots are for churches or any commercial uses, and these uses abut residential <br /> uses. In studying this request, the Planning Commission and staff expanded the scope of the proposed <br /> amendment to include setting a minimum lot size for non-residential uses in residential districts, and to clarify <br /> other provisions in the Zoning Code related to setbacks. The Planning Commission is also recommending that <br /> he setback between parking lots for non-residential uses and residential properties be 20 feet for sites of 2.5 <br /> acres or less, and 30 feet for sites of more than 2.5 acres. These dimensions are larger than the 15 feet <br /> requested by Mr. Moon, and are based on the setbacks observed on existing church sites in Mounds View. <br />
