Explanation/Summary(attach supplement sheets as necessary) Summary: MEMORANDUM TO: Chuck Whiting, City Clerk-Administrator FROM: Joyce Pruitt, Acting Community Development Director RE: Public Hearing Scheduled for 7:15 p.m. on Monday, June 24, 1996, to Consider Ordinance No. 584, an ordinance amending Title 1123 entitled, "Nonconforming Building Structures and Uses" of the Mounds View Municipal Code. DATE: June 17, 1996 March 07, 1996, a variance request to allow the placement of a 24'x 44' canopy atop a gas pump island at 80 County Road I, in Planning Case No. 438-96, was denied by the City Council. The applicants, Tom e-l Manke& Leon Theis, owners of Mounds View Fina, requested a variance for a twenty-four foot encroachment into the required thirty foot front yard setback. The Planning Commission denied this request and the City Council upheld the denial. Denial was based on the findings that adding a significant new structure, such as the gasoline pump canopy, would be an enlargement of the existing structure or use on the site and would thus be prohibited under Section 1123.02, Subd. 1, of the City Code. When Planning Case No. 438-96 was presented to the City Council, the applicants were notified that the City Council would consider a new proposal for less of an encroachment into the required setbacks. The applicants have submitted a revised site plan for consideration. On June 05, 1996, the revised site plan was submitted for Planning Commission review and recommendations. The revised site plan showed a smaller canopy, 20' x40', to encroach eight feet into the required front yard setback. The revised plan shows the canopy outside the required thirty front yard setback off County Road I and encroaching eight feet into the required thirty foot setback off Adams Street.
