Mounds View Planning Commission June 5, 1996 <br /> Regular Meeting Page 3 • <br /> The Planning Commission agreed that they <br /> should discuss amending Chapter 1123 and <br /> then enter into discussion on the variance <br /> request and that the issue is the nonconformity <br /> of the structure and not the variance. <br /> The Planning Commission discussed how <br /> installing the canopy would improve the <br /> property. (At this time the applicant, Tom <br /> Manke, noted that the gasoline station started <br /> operation in 1952). <br /> Again, the Planning Commission reiterated that <br /> the issue is whether or not the canopy is an <br /> enlargement and should the Code be changed? <br /> If was noted that if the use of the property <br /> lapses for at least six months, the present use <br /> as a gas station could not continue. <br /> 411 <br /> The applicant, Mr. Manke, addressed the <br /> Planning Commission stating that he had <br /> started a petition and had received over 300 <br /> signatures, approximately 80 percent were <br /> Mounds View residents and 20 percent were <br /> Shoreview residents (see Exhibit 1). <br /> The Planning Commission expressed that <br /> applicant has done his best to do what is <br /> necessary to make this request work. <br /> It was noted that no other gasoline stations in <br /> Mounds View are a legal non-conforming use, <br /> however, many other businesses are. <br /> ActingDirector Pruitt reminded the Commission <br /> that there is a 60-day deadline if they are <br /> considering tabling the item and that <br /> permission must be received by the applicant <br /> or they would have to deny the request. She <br /> informed them that they could approve the • <br /> variance contingent upon receiving a Code <br />
