• <br /> • <br /> Dear City Council Members: <br /> The Planning Commission has denied our request for a canopy at 2280 W. Cty. Rd. I because <br /> of a land use issue. We are hoping the policy direction of the City Council will override this <br /> decision. <br /> We would like to remodel the existing facility with a canopy for the folowing reasons: <br /> -The underground tanks and product piping are 40 years old. We would like to replace these as <br /> soon as possible to allevite any possible petroleum releases in the future. <br /> -The present clean-up system now in place will take between 10 to 15 years. If we could <br /> remodel, this system would be replaced by one that will only take from 1 to 2 years. <br /> - Putting up a canopy would provide shelter and security for our customers and employees, and <br /> modernize the facility to today's standards. <br /> -If no canopy is allowed, the location maybe left as is. - - <br /> 111 <br /> The Planning Commission turned us down because we are trying to add a structure to a non- <br /> conforming piece of property. Four of the six members went on record as saying we hope that <br /> you go to the City Council so that they might override our decision. All six members said that <br /> what we want to do is in the best interest of the City of Moundsview. <br /> When considering our request for a canopy, the Federal government says that a canopy is not a <br /> permanent structure because it can be removed at anytime. A building depreciates over 39 1/2 <br /> years, a canopy depreciates over 7 years. <br /> We believe that by allowing us to make improvements to this property the City of Mounds View <br /> benefits. It will provide security for our customers and employees.
