Gengel, Common Counsel <br /> DATE: April 16, 1996 <br /> RE: Execution of Reimbursement Agreement <br /> The purpose of this memorandum is to advise you that the Oak Grove Site is now in • <br /> the Minnesota Landfill Cleanup Program ("LCP"), and to request that each party which <br /> desires to participate in the LCP and receive reimbursement from the State execute the <br /> attached Reimbursement Agreement and return the original signature page to me bv_ <br /> next Tuesday, April 23, 1996. <br /> The Landfill Cleanup Agreement was finally executed by the State of Minnesota on <br /> March 5, 1996. The Oak Grove Site should receive its Notice of Compliance from MPCA <br /> this week. Issuance of Notice of Compliance is important to the Trust, because it is at this <br /> point that MPCA formally takes over responsibility for the Site. Once MPCA takes over <br /> responsibility for the Site, the Trust's O&M obligations and expenses end. <br /> Pursuant to the terms of the LCP, after we receive the Notice of Compliance, two <br /> steps remain to become eligible for reimbursement. <br /> 1. Parties who desire reimbursement must execute the attached Reimbursement <br /> Agreement. Only parties who execute the Agreement are eligible for reimbursement. Please <br /> carefully review the Agreement so that you understand your rights and obligations under the <br /> Agreement. You may wish to consult with your attorney.
