These include minimum setback requirements, lot sizes, lighting <br /> requirements, landscaping requirements, ratio of area to cars that can be sold on the <br /> property and proper drainage systems. <br /> Mr. Harrington noted there were three corrections that needed to be made to the <br /> ordinance as it was presented to the Council. These included: <br /> Item G - "no mechanical car washes shall be allowed on site" should be struck from <br /> the ordinance (they are a separate CUP and they would need to apply for it if they <br /> were to locate one on the site); <br /> Item 0 - the hours of operation of the facility shall not exceed 7 a.m. to 10 p.m., <br /> rather than shall be 7 a.m. to 10 p.m. <br /> Item 0 - no music or advertisements shall be allowed over the paging system of the <br /> facility. <br /> Mr. Harrington stated staff is recommending that the Council formally introduce <br /> Ordinance 570 and also set a Public Hearing for January 8, 1996 to consider public <br /> input on it. <br /> MOTION/SECOND: Trude/Blanchard to Introduce Ordinance No. 570 with the <br /> amendments as noted by Mr. Harrington, to waive the reading of such ordinance, and <br /> to set a Public Hearing for January 8, 1996 at 7:05 p.m. <br /> Mr. Ken Sjodin, representing Mr. and Mrs. Mullins who own the Mid-America Car <br /> lot asked if the new ordinance will affect them as their property is an existing lot. <br /> Mayor Linke stated it is not an existing car lot as they went out of business and <br /> because of the moratorium, the moment they stop operation, it is no longer <br /> considered a car dealership. They no longer have a Conditional Use Permit on that <br /> property for that use. Therefore, it is not a used car lot dealership at this time, <br /> rather just a commercial property. <br /> Mr. Shedeen stated he has a potential buyer for the property, contingent upon <br /> approval of its use as a used car dealership. If the property is not "grandfathered in" <br /> due to the fact that its operation ceased, the property will likely not meet the new <br /> requirements set forth in the ordinance. He asked when they anticipate that the <br /> ordinance will go into effect. <br /> • <br />
