The use, in the opinion of the City Council, is reasonably related to the overall <br />needs of the City and to the existing land use. <br />5. The use is consistent with the purposes of the Zoning Code and the purposes of <br />the zoning district in which the applicant intends to locate the proposed use. <br />6. The use is not in conflict with the Comprehensive Plan of the City. <br />7. The use will not cause traffic hazards or congestion. <br />8. Adequate utilities, access roads, drainage and necessary facilities have been or <br />will be provided. <br /> <br />Additional criteria specific to oversized garages in the R-1 district, include; the garage <br />shall have a uniform appearance with the home; the garage cannot exceed 35’ in width <br />(23’-4’ proposed); and the garage shall be a permanent structure.4 <br /> <br /> <br />Summary <br />The applicant has requested a Conditional Use Permit for a 1,227 sq ft oversized <br />garage, attached to the home. <br /> <br />The Planning Commission reviewed the request on October 19, 2016, and <br />recommended approval of the CUP (Resolution 1057-16). <br /> <br />A Public Hearing notice was published in the New Brighton-Mounds View Sun Focus on <br />Sept 30, 2016, and mailed to property owners within 350’ of the subject property. <br /> <br /> <br />Recommendation: <br />Staff requests that the City Council conduct a Public Hearing, and recommends <br />approval of Resolution 8646, approving a Conditional Use Permit for a 1,227 sq ft <br />accessory building. <br /> <br />The addition to the attached garage will decrease the front yard setback from 75’ to 51’ <br />(minimum 45’ required), and will be closer to the street than the neighboring home, but <br />is consistent with requirements of the City Code. <br /> <br />Respectfully submitted, <br /> <br /> <br />________________________ <br />Jon Sevald, AICP <br />Planner <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />4 City Code, Section 1106.04, Subd 6
