<br />Item No: 08B <br />Meeting Date: November 28, 2016 <br />Type of Business: Consent Agenda <br />Administrator Review : ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 8667, a Resolution Adopting a Minnesota <br />Government Data Practices Act Policy and Designating the <br />Responsible Authority and Compliance Official <br /> <br />Introduction: <br /> <br />In light of recent public data requests submitted to cities throughout the metro area, the <br />City Attorney advised that it would be beneficial to review the existing policy which was last <br />updated in 2010 and make changes to bring the policy into compliance with current <br />Minnesota Government Data Practice Act (MGPDA) requirements. As such, a newly <br />updated policy is available for approval. No substantive changes were made, only <br />revisions corresponding to revisions to the applicable state law and correction of typos. <br /> <br />Discussion: <br /> <br />Minnesota Statutes Chapter 13, otherwise known as the Minnesota Government Data <br />Practices Act, requires that the City adopt a Minnesota Government Data Practices Act <br />policy which among other things designates the (1) individual responsible for the collection, <br />use, and dissemination of any set of data on individuals, government data, or summary <br />data (the “Responsible Authority”) for the City, and (2) the individual responsible for <br />persons to direct questions or concerns regarding problems in obtaining access to data or <br />other data practices problems for the City (the “Compliance Official”). <br /> <br />The City Administrator has been designated and will continue to be designated the <br />Responsible Authority and Compliance Official. The MGDPA Policy also identifies the <br />Assistant City Administrator as the designee in system administration. Other persons <br />responsible for the maintenance and dissemination of City records are as apparent or <br />assigned. <br /> <br />Recommendation: <br /> <br />Staff recommends approval of Resolution 8667, a resolution updating the City’s Minnesota <br />Government Data Act policy and reaffirming the City Administrator to be the Responsible <br />Authority and Compliance Official. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />City Administrator
