<br />Chicken Report <br />May 26, 2015 <br />Page 2 <br /> <br />If the Council were to consider amending the Code to allow poultry or fowl, it would need to <br />address many issues. Staff has reviewed codes and regulations from other metro area <br />communities and has come up with some draft requirements, such as the following: <br /> <br />• No more than 8 poultry or fowl would be permitted. <br />• R1 / R2 residentially zoned properties only. <br />• No roosters would be allowed. <br />• Annual permit and fee required, inspection as deemed necessary. <br />• Initial permit fee $100, annual renewals thereafter $30 <br />• Written consent of neighbors? <br />• No slaughtering / beheading on premises. <br />• Birds must wear leg bands with owner’s contact information. <br />• Yards shall be fenced, birds confined to property. <br />• Coops shall be located at least 20 feet from a lot line and at least 20 feet from house <br />• Coops shall be maintained in a clean and sanitary manner. <br />• Coops shall be considered an accessory building, permit required. <br />• Permit can be revoked/denied by the Council for cruelty, negligence or nuisance. <br /> <br />If the Council supports moving forward with amendments to allow poultry and fowl, staff <br />would suggest reviewing the above proposed conditions and requirements, and discuss the <br />option of requiring neighbor consent. As an alternative to written neighbor consent, the <br />Council could elect to require that all initial permits be approved by the Council after <br />holding a public hearing with notices sent to property owners within 350 feet of the subject <br />property. (As an alternative, if the applicant submits written consent from all adjoining <br />property owners, no hearing would be required.) Renewals could be approved <br />administratively unless complaints have been made during the previous permit period. <br /> <br /> <br />Recommendation: <br /> <br />If the Council is content with the proposed requirements, staff will prepare an ordinance to <br />amend the Code as directed.
