8382 Knollwood Drive Variance Appeal Report <br />June 8, 2015 <br />Page 3 <br /> <br /> <br />May 20, 2015 Planning Commission meeting result: <br /> <br />The Planning Commission discussed this case, one neighbor commented, and the Commission <br />ultimately denied the variance by a 4-2 vote. Commissioners Love and Kieffer voted against the <br />denial because they felt it was a reasonable request. <br /> <br />Per the Zoning Code, Mr. Horbul had 60 days to appeal the Planning Commission’s denial to the <br />City Council, and opted to do that with a written request submitted to the City on May 21, 2015. <br /> <br />Public Comments: <br />Staff has received two written comments in support, and a third neighbor attended the Planning <br />Commission meeting and spoke in favor of the applicant’s request. <br /> <br />Council Actions: <br /> <br />Consider testimony from staff and the applicant and documentation. If the Council believes that <br />the Planning Commission’s action was appropriate and that the findings contained in Planning <br />Commission Resolution 1027-15 are proper, the Council could approve Version 1 of Resolution <br />8427. This is a resolution that upholds the Planning Commission denial by rejecting the <br />applicant’s appeal. <br /> <br />If the Council finds there is in fact sufficient practical difficulty to justify the applicant’s variance <br />request (thus overturning the Planning Commission’s denial), the Council could approve Version <br />2 of Resolution 8427.
