<br />Item No: 7E <br />Meeting Date: September 14, 2015 <br />Type of Business: Council Business <br />Administrator Review : __________ <br /> <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Resolution 8454, Approving a Limited Use Agreement and an <br />Assignment of Limited Use Agreement for 8160 Red Oak <br />Court <br /> <br /> <br />Discussion: <br /> <br />The property owners of 8160 Red Oak Court, Gary and Margaret Krig, built an in-ground <br />swimming pool in their back yard in 1989. About half of the backyard of this property is <br />covered by a drainage and utility easement. The owners asked if the City would either <br />vacate part of the easement or give permission to place the pool in the easement area. <br />Since this easement area is designated for overflow from a retention pond for this cul-de- <br />sac, the City opted for an Easement Use Agreement between the City and the Krigs. <br /> <br />The Krigs are now selling the property, so the Easement Agreement needs to be <br />reassigned to the new owners and an agreement between the City and the new owners <br />signed. The City Attorney has drafted new Limited Use Agreement documents. The title <br />company will coordinate the Krigs and new owners signing the documents and recording <br />them with Ramsey County.
