<br /> <br />EDA Enabling Language Report <br />November 9, 2015 <br />Page 2 <br /> <br />Public Notice: <br /> <br />To amend the EDA enabling legislation, Minnesota Statutes require that a written notice of <br />the public hearing be published in a newspaper of general circulation within the City once a <br />week for two consecutive weeks prior to the public hearing, the first date of which not <br />occurring more than 30 days prior to the public hearing. The first date of publication was <br />November 6th, the second date of publication one week later, on November 13, 2015. <br />Because of the two consecutive published hearing notices, action on the attached <br />resolution cannot occur until November 23, 2015, as stated in the published notice. The <br />public hearing can be opened (since it had been noticed at the previous Council meeting) <br />but no action can be taken. The public hearing will need to be continued until November <br />23, 2015, pursuant to the published notice. <br /> <br /> <br />Recommendation: <br /> <br />Staff recommends the City Council open the public hearing for this matter and move to <br />continue the public hearing to the November 23, 2015, meeting, consistent with the <br />published notice, taking no action on the resolution until such time. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />City Administrator <br /> <br />Attachments: <br />1.
