Item No: 07A <br />MOUNDS MW Meeting Date:: Council <br />24, Business S �/1 Type of Business: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 8220 Approving a Settlement Agreement and <br />Release of Claims <br />Introduction: <br />The City had scheduled and held a public hearing on November 25, 2013, to receive input <br />regarding a proposed assessment of unpaid private sewer repairs at 2508 County Road I. <br />The property owner, Rajiv Garg, attended the meeting to express objection to the amount <br />of the assessment and City policies relating to the repairs. <br />Discussion: <br />After hearing Mr. Garg's concerns and testimony regarding the proposed assessment, the <br />City Council moved to defer approval of the special assessment to allow for an opportunity <br />to negotiate a mutually agreeable resolution to avoid a potential challenge to the <br />assessment. Mayor Flaherty and Council Member Hull were selected to attend a <br />negotiation session with City staff, the City Attorney, Mr. Garg and Mr. Garg's attorney. <br />The negotiation session took place on January 8, 2014. From this negotiation, a tentative <br />agreement was made on a payment less than originally proposed subject to Council <br />approval. The City Council met in closed session to consider the proposed settlement on <br />January 27, 2013, at which time direction was received to prepare a settlement agreement <br />in the amount of $30,000. <br />Recommendation: <br />The City Attorney has prepared Resolution 8220 and the attached Settlement Agreement <br />by and between the City and Pleasant Lake, regarding the sewer repair work performed by <br />the City on the Property owned by Pleasant Lake and in the County Road I right-of-way <br />adjacent to the Property located at 2508 County Road I in the City. <br />Respectfully submitted, <br />J <br />James Ericson <br />City Administrator <br />
