Resolution 8304 Page 2 <br /> 3. The proposed telecommunications tower would not be out of place given the industrial character of the surrounding area involved. <br /> <br />4. The proposed telecommunications tower would not depreciate the neighboring <br />properties. <br /> <br />5. The applicant has sufficiently demonstrated that a need exists for expanded <br />telecommunications coverage in the Mounds View area. <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves a conditional use permit for the telecommunications tower, with conditions as <br />follows: <br /> <br />1. Access to the equipment shall be protected by a secure 8-foot chain link fence. <br /> <br />2. No advertising signage will be allowed attached to the pole or fencing. <br /> <br />3. The tower shall not exceed 150 feet in height or have any lighting. <br /> <br />4. The Conditional Use Permit (CUP) shall become null and void if the work for <br />which the CUP was granted is not completed within one year from the date of <br />approval unless a petition for extension of time in which to complete the work has <br />been granted by the City Council. <br /> <br />NOW THEREFORE, BE IT FURTHER RESOLVED that this Conditional Use Permit <br />shall have no expiration date and shall remain in force so long as the conditions agreed <br />upon herein are observed. <br /> <br /> <br />Adopted this 22nd day of September 2014. <br /> <br /> <br />_____________________________________ <br />Joe Flaherty, Mayor <br />ATTEST: <br /> <br /> _____________________________________ <br />James Ericson, City Administrator <br />(SEAL)
