To Waive the Reading and Adopt Resolution 8277, 2 <br />Adopting a Special Assessment Levy for Unpaid Administrative Offense Charges and Nuisance 3 <br />Abatement Charges. 4 <br /> 5 <br /> Ayes – 5 Nays – 0 Motion carried. 6 <br /> 7 <br />B. 7:00 p.m. Public Hearing, Resolution 8274, Consideration of the “Anna 8 <br />Place” Preliminary Plat and Comprehensive Plan Amendment for a 5-Lot 9 <br />Major Subdivision at 8211 Red Oak Drive. 10 <br /> 11 <br />Planning Associate Heidi Heller stated Terry Buchanan, representing Kayak Remodeling & 12 <br />Redevelopment, has submitted an application for a major subdivision of the east two acres of 13 <br />8211 Red Oak Drive and a Comprehensive Plan Map Amendment. The proposed subdivision 14 <br />would create five (5) additional lots from the existing one lot and change the land use designation 15 <br />of the two acres from church (CH) to single family detached (SFD). 16 <br /> 17 <br />Planning Associate Heller explained that Abiding Savior Church owns the property at 8211 Red 18 <br />Oak Drive, which is a 7-acre parcel with a church building and large parking lot. This property is 19 <br />zoned R-1, Single Family Residential, but the Comprehensive Plan Existing and Future Land Use 20 <br />Maps designate the property as “church.” The proposed subdivision would create five new 21 <br />single-family buildable lots, which would be consistent with the existing zoning of the property, 22 <br />but not consistent with the Comprehensive Plan. All of the lots shown on the preliminary plat 23 <br />meet the minimum lot size requirements: 11,000 square feet and 75 feet wide for interior lots, 24 <br />and 12,500 square feet and 100 feet wide for corner lots. 25 <br /> 26 <br />Planning Associate Heller indicated the streets near Abiding Savior Church were being 27 <br />reconstructed in 2014, which made it possible for the water and sewer stubs to be connected. 28 <br />She explained that the applicant was awaiting Rice Creek Watershed approval. She discussed 29 <br />the proposed park dedication fees and recommended $3,857 per lot be charged to the developer. 30 <br />She indicated the church had purchased an adjacent residential lot in 2007 and paid $3,984 in 31 <br />park dedication fees for a lot that was never developed. She recommended the Council consider 32 <br />allowing this previously paid amount be credited to the new park dedication fees. Staff reported 33 <br />the Planning Commission reviewed this case at their July 2 nd meeting and recommended 34 <br />approval of the Preliminary Plat and Comprehensive Plan Amendment for a 5-lot Major 35 <br />Subdivision at 8211 Red Oak Drive. 36 <br /> 37 <br />Mayor Flaherty opened the public hearing at 7:48 p.m. 38 <br /> 39 <br />Dale Oakey, 2458 Sherwood Road, Abiding Savior Church representative, thanked staff for the 40 <br />thorough report. He appreciated the Council’s consideration and requested the previously paid 41 <br />park dedication funds be allowed to be credited to the new subdivision. 42 <br /> 43 <br />City Administrator Ericson stated the City could use the previous park dedication formula and 44 <br />reevaluate the amount due from the applicant. 45
