An option limiting sales to adult -only tobacco products shops: <br />The following sample language would limit sales of electronic delivery devices to adult -only <br />tobacco retail establishments that cannot be entered by minors at any time. <br />Subd XX. [title/. It shall be unlawful for any person licensed under this ordinance to allow the <br />sale of any electronic delivery device in any retail establishment other than a tobacco products <br />shop that has an entrance door opening directly to the outside, derives more than 90 percent of its <br />gloss revenue from the sale of tobacco or tobacco products and where the sale of other products <br />is merely incidental, and where no person under the age of eighteen (18) is present, or permitted <br />to enter, at any time. <br />A total prohibition option: <br />The following sample language would prohibit sales of electronic delivery devices. <br />Subd XXtitle . It shall be unlawful for any person licensed under this ordinance to sell or offer <br />to sell an electronic delivery device. <br />Responsibility (of licensee) section: <br />This provision would be amended to delete the reference to "nicotine and lobelia delivery <br />device," replacing it with "electronic delivery device." <br />Compliance checks section: <br />This provision would be amended to delete all references to "nicotine and lobelia delivery <br />device" and replace them with "electronic delivery device." <br />Other prohibited acts section: <br />This section would be amended to delete references to "nicotine and lobelia delivery device" and <br />replace them with "electronic delivery device." The "illegal use" text could be amended to <br />include "inhale" as described below. <br />o Illegal use.
