Res. 7885, Considering Stormwater Infiltration Program Appeals in Area E
Page 4
5173 Red Oak Drive (Barbara Kosiak) – SIP#88
The property owner is appealing for the following reasons:
1. worried about large maple near boulevard
• The tree is located near the middle of the turf boulevard area and property owner would like
to have tree protected. Due to further investigation of the site and grade issues, the length of
the basin will be shortened and located north of the tree and outside the tree dripline,
whereby significantly reducing the risk of any negative impact on the adjacent tree.
• The proposed infiltration basin length is 20 feet. The total boulevard length between the
driveway and north property line is 62 feet.
City staff and the S/U Committee recommend denying this appeal. City staff spoke with
Mrs. Kosiak who is OK with the basin as planned.
2760 Woodale Drive (Amy Hermanek) – SIP#94
The property owner is appealing for the following reasons:
1. safety concerns (B1); and
2. limiting the use of the lawn (B4).
• Property owner uses a wheel chair full-time and is concerned with safety while in the vicinity
of the proposed basin, as well as concerns that the basin will be built across the entire
frontage and limit her ability to travel between the lawn and street pavement. Property
owner would rather have basin built on west side of driveway, but if it needs to be built on
east side, she requests that it not take up the entire length of the boulevard.
• Property owner will have a difficult time traveling from the lawn to the street pavement since
a 6 inch high vertical curb will be constructed, regardless if a basin is constructed in the
boulevard or not.
• Design engineers are investigating the possibility of constructing the basin on the west side
of the driveway.
• The proposed feature length is 38 feet. The total boulevard length between the driveway
and east property line is 54 feet.
City staff and the S/U Committee recommend denying this appeal. City staff spoke with Ms.
Hermanek about her concerns and the possibility of constructing the basin on the west side of
her driveway. Soil borings will determine if this alternative location will be acceptable.

Recommendation:
Staff recommends that the City Council consider adopting the attached resolution that will
deny the seven SIP appeals received in Area E of the Street and Utility Improvement
Program.

Respectfully submitted,

Nick DeBar - Public Works Director

Attachments:
Resolution 7885
SIP Notice
SIP FAQ handout
Area D Stormwater Infiltration Basin Location Map (2 sheets)
Appeal Forms
