<br /> <br />Resolution 7903 <br />Page 2 <br /> <br /> <br /> <br />WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View Municipal <br />Code, the Planning Commission is to review a standard set of criteria, of which all must be <br />satisfied, in order to grant a variance to the Zoning Code. <br /> <br /> WHEREAS, the purpose of the variance provision in the Zoning Code is to give relief to <br />property owners when the strict enforcement of the code requirements imposes hardship <br />thereby restricting the improvement of the property due to practical difficulties brought about <br />by the unique or extraordinary features of the physical property that are beyond the property <br />owner’s control; and, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council does <br />hearby uphold the decision of the Mounds View Planning Commission to deny Tim Downing, <br />property owner of 8027 Woodlawn Drive, a variance to allow a detached garage to exceed the <br />18-foot accessory building height limit, incorporating herein by reference, the same findings of <br />fact as stated in the Planning Commission’s resolution of denial. <br /> <br /> <br />Adopted this 12th day of March, 2012. <br /> <br /> <br />_________________________________ <br />Joe Flaherty, Mayor <br /> <br />ATTEST: <br /> <br />__________________________________ <br />James Ericson, City Administrator <br /> <br />(SEAL) <br /> <br />
