<br /> <br />Resolution 7927 <br />Page 2 <br /> <br /> <br />2. The provisions of the Zoning Code and of Resolution 7338 would not deprive the <br />property owners the ability to have adequate access to their property. <br /> <br />3. Granting the applicants approval for a wider than allowed curb cut would confer <br />upon the property owner a special privilege that the City would not extend to other <br />property owners in the street and utility improvement program. <br /> <br />4. The approval for a wider curb cut would be detrimental to the purpose of the City <br />Code, to the street and utility program and to other property in the street and utility <br />program in that the City desires to bring nonconforming driveways into conformance <br />with the City Code whenever possible. <br /> <br />5. The wider curb cut could diminish or impair property values within the street and <br />utility program and negatively affect the city’s vision for improvement to the streets <br />and to properties within the project area. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings of <br />fact and testimony provided the City Council meeting, the Mounds View City Council upholds <br />and affirms the decision of City staff to follow the City standards set in Resolution 7338 for <br />non-conforming driveways by denying the requested wider curb cut for the property at 5177 <br />Red Oak Drive. <br /> <br /> <br />Adopted this 23rd day of April, 2012. <br /> <br /> <br /> <br /> <br />____________________________ <br />Joe Flaherty, Mayor <br /> <br /> <br />ATTEST <br /> <br />____________________________ <br />James Ericson, City Administrator <br /> <br /> <br />(SEAL) <br /> <br />
