Item No: 07A Meeting Date: May 29, 2012 Type of Business: CB Administrator Review: ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Desaree Crane, Assistant City Administrator Item Title/Subject: Continued Public Hearing, Resolution 7938, an On-Sale Intoxicating Liquor License for Moe’s located at 2400 County Highway 10 Background: In accordance with Chapter 502 of the Mounds View City Code, a public hearing is required for all liquor licenses. This public hearing was originally scheduled on May 14th, but the public hearing needed to be continued to this meeting because Staff did not receive liquor license application materials before the May 7th deadline. Staff received all required liquor application materials and fees on the afternoon of May 22nd. The owner of Moe’s was notified that the public hearing was postponed to this meeting. Discussion: The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice of Public Hearing was published in the City’s official newspaper. Property taxes on this property are current. Moe’s submitted all required City liquor license application materials and fees. The following investigations and inspections have been conducted to determine whether there is cause for the City to deny the applications: Police Inquiry and Investigations The Mounds View Police Department has issued a satisfactory report for Moe’s. Staff has submitted a background check application on the owner of Moe’s to the Minnesota Bureau of Criminal Apprehension (BCA). Staff has not received yet received the background check report. The liquor license will be contingent on a satisfactory criminal background check. City Billing Finance Department has issued a satisfactory report for 2400 County Highway 10. Fire Inspection (Mounds View Fire Marshal) The City’s Fire Marshal states that there continues to be one outstanding issue that Moe’s is required to correct before the Fire Marshal can issue a satisfactory report. Staff recommends this liquor license be contingent on a satisfactory report from the Fire Marshal. Recommendation: Staff recommends approving Resolution 7938, approving an On-Sale Intoxicating Liquor for Moe’s located at 2400 County Highway 10 in Mounds View, contingent on a satisfactory report from the Minnesota Bureau of Criminal Apprehension and a satisfactory report from the Fire Marshal. If this renewal is approved, the time period of this license will be July 1, 2012 to June 30, 2013. Respectfully Submitted, ___________________________ Desaree Crane
