<br /> <br />RESOLUTION NO. 7957 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING A REQUEST FOR A SECOND CURB CUT <br />AT 5101 BRIGHTON LANE <br /> <br /> <br />WHEREAS, Michael and Melinda Collins, property owners of 5101 Brighton Lane, have <br />requested City approval to allow a second curb cut to be installed on the south side of their <br />property; and, <br /> <br />WHEREAS, 5101 Brighton Lane is a corner lot with street frontage on Brighton Lane <br />and Woodcrest Drive; and, <br /> <br />WHEREAS, the attached garage and driveway face and access Brighton Lane, but a <br />backyard concrete area has been used occasionally for parking vehicles with access from <br />Woodcrest Drive; and, <br /> <br />WHEREAS, the City Council adopted Resolution 7338 on September 22, 2008 that set <br />the policies and standards for nonconforming driveways within the street and utility <br />improvement program: and: <br /> <br />WHEREAS, Resolution 7338 states that the City will allow multiple driveway accesses <br />to single family residential properties only if all five of the conditions are met; and, <br /> <br />WHEREAS, Condition 1a of the five City-required conditions states “The access <br />beyond the primary access existed prior to January 2000, or has been permitted by the City <br />through an approved variance or other acceptable means”; and, <br /> <br />WHEREAS, there is no true driveway access from Woodcrest Drive, nor has the City <br />has not given any type of approval for a second curb cut on this property; and, <br /> <br />WHEREAS, Condition 1b of the five City-required conditions states “The access in <br />question has an improved surface in compliance with City Code requirements”; and, <br /> <br />WHEREAS, there is no improved surface between the street and the property line; <br />and, <br /> <br />WHEREAS, this appeal does not meet all the conditions for nonconforming driveways <br />set by the Council in Resolution 7338; and, <br /> <br />WHEREAS, Mr. and Mrs. Collins have appealed the decision of City staff to deny their <br />second curb cut. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes the <br />following findings of fact about Michael and Melinda Collins’ request for a second driveway <br />curb cut at their property at 5101 Brighton Lane:
