If a license is mistakenly issued or renewed to a person, it shall be revoked upon <br /> the discovery that the person was ineligible for the license under this chapter. <br /> <br /> <br />Under Section 512.05 subd 1(b), the violation, which occurred on June 6, 2007, appears to be <br />within five (5) years of the violation, which could be grounds for denying the license <br />application. However, under Section 512.05, subd. 2, it states that the existence of any <br />particular ground for denial does not mean that the City must deny this license. Essentially, <br />the City Council could either approve or deny the license and still be compliant under this <br />section of the City Code. <br /> <br />The owner of ABC Liquor Ge Xiong will be present at the City Council Meeting to answer any <br />questions you may have. Mr. Xiong has submitted the required application materials and fees <br />for this license. ABC Liquor also received a satisfactory fire inspection report with the City’s <br />Fire Marshal. <br /> <br /> <br />Recommendation: <br /> <br />The City Council could either deny the license application on the grounds that the violation <br />occurred within five years or the City Council could approve the license under Section <br />512.05, subd. 2 of the City Code.
