Item No: 7E <br />Meeting Date: August 13, 2012 <br />Type of Business: Action <br />City Administrator Review: _______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Resolution 7975, Approving a Variance Extension for the <br />“Longview Estates” Development; <br /> <br />Introduction: <br />In August 2010, the City Council passed Resolution 7658 that approved a variance to allow <br />for reduced lot widths in a wetland district. The Planning Commission originally denied the <br />variance, but the City Council approved the applicant’s appeal. Per city code, an applicant <br />has one year after the variance or appeal is granted to complete the work or the approval is <br />void unless an extension has been granted. <br /> <br />Chapter 1125.02: Variances and App eals <br />Subd. 5. Lapse of Variance or Appeal: Whenever, within one year after granting a variance <br />or appeal, the work as permitted by the variance or appeal shall not have been completed, <br />then such variance or appeal shall become null and void unless a petition for extension of <br />time in which to complete the work has been granted by the Board of Adjustment and <br />Appeals, such extension shall be requested, in writing, and filed with the City Administrator <br />at least thirty (30) days before the expiration of the original variance or appeal. There shall <br />be no charge for the filing of such petition. The request for extension shall state facts, <br />showing a good faith attempt to complete the work permitted in the variance or appeal. <br /> <br />Discussion: <br />The City Council approved a one-year extension in 2011 for this variance. Marty Harstad, <br />representing Eichi, Inc. has submitted a letter requesting another one-year extension of the <br />variance, as allowed per City Code. The housing market is showing signs of improvement, <br />and Mr. Harstad feels that they could possibly complete the major subdivision of the <br />Longview Estates property next year. <br /> <br />Recommendations: <br />Staff requests the City Council pass Resolution 7975, approving a one-year extension for the <br />variance approving reduced lot widths in a wetland district on the Longview Estates property. <br /> <br />Respectfully submitted, <br /> Heidi Heller <br />Planning Associate <br /> <br />Attachments: <br />1.
