Item No: 7I <br />Meeting Date: August 27, 2012 <br />Type of Business: ROLL CALL VOTE <br />Administrator Review : ______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Second Reading and Adoption of Ordinance 858, an <br />Ordinance Approving the Vacation of Drainage & Utility and <br />Water Main Easements on 2320 County Road 10 and 5260 <br />O’Connell Drive, as part of the Coventry Senior Living <br />Development (ROLL CALL VOTE) <br /> <br />Introduction: <br /> <br />A developer, Coventry Senior Living, plans to construct a 95-unit senior housing building on <br />three parcels, 2320-2340 County Road 10 and 5260 O’Connell Drive. There are several <br />existing easements on two of the parcels. To simplify the easements and since the <br />developer/owner will replat the properties for this development, they are proposing to vacate <br />the existing water main and drainage and utility easements, and would then dedicate one <br />new easement on the final plat that would cover everything needed. <br /> <br />Discussion: <br /> <br />The City’s engineer consultant and City Staff have reviewed the easement vacation request <br />and have determined that the proposal is acceptable. To vacate an easement or other <br />public interest in a parcel, the City must determine that the easement no longer serves a <br />public purpose. In this case, the developer would dedicate a new easement where the <br />current easements are. This vacation request eliminates the multiple easements and <br />creates one easement in their place. <br /> <br />The City Council held the first reading of this ordinance on March 28, 2011, but held off on <br />the adoption until City Staff felt there was enough evidence showing that this project was <br />actually going to move forward. <br /> <br />Recommendation: <br /> <br />Staff recommends Council approval of Ordinance 858. Action on the ordinance is by a roll <br />call vote of the Council. Staff also recommends the Council consent to the publication of a <br />summary of the ordinance as authorized by City Charter section 3.07. <br /> <br /> Heidi Heller <br />Planning Associate <br /> <br />Attachments <br />1.
