<br />RESOLUTION 7993 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AUTHORIZING AN ADMINISTRATIVE PENALTY TO <br />CVS PHARMACY LOCATED AT 2800 COUNTY ROAD 10 FOR <br />VIOLATION OF SECTION 512 OF THE MOUNDS VIEW CITY CODE <br /> <br /> <br /> WHEREAS, on August 27, 2012, the Mounds View Police Department, along with <br />the North Suburban Tobacco Compliance Project, conducted tobacco compliance checks <br />on the thirteen licensed businesses that sell tobacco and cigarettes; and <br /> <br /> WHEREAS, CVS Pharmacy, located at 2800 County Road 10, failed the compliance <br />check by selling cigarettes to someone under the age of eighteen; and <br /> <br /> WHEREAS, selling tobacco and cigarettes to someone under the age of eighteen, is <br />in violation of state law and the Mounds View City Code Chapter 512; and <br /> <br /> WHEREAS, under Section 512.11, subd. 1, of the City Code states that if a licensee <br />or an employee of a licensee violates any provision of Chapter 512, the licensee shall be <br />charged an administrative penalty of one-hundred fifty dollars; and <br /> <br /> WHEREAS, CVS Pharmacy was notified by certified mail of the violation and <br />administrative penalty in accordance with the City Code. <br /> <br /> NOW, THEREFORE BE IT RESOLVED, that under Section 512.11, subd 1, of the <br />Mounds View City Code, CVS Pharmacy shall be issued an administrative penalty in the <br />amount of one-hundred fifty dollars for violating Chapter 512 of the City Code for selling <br />cigarettes to someone under the age of eighteen. <br /> <br />Adopted this 24th day of September, 2012. <br /> <br /> <br />__________________________________ <br />Joe Flaherty, Mayor <br /> <br />ATTEST: <br /> <br />__________________________________ <br />James Ericson, City Administrator <br /> <br /> <br />(seal) <br />
