Item No: 7B <br />Meeting Date: March 28 2011 <br />Type of Business: Public Hearing <br />Administrator Review: ______ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Public Hearing, Introduction and First Reading of <br />Ordinance 858, an Ordinance Approving the Vacation of <br />Drainage & Utility and Water Main Easements on 2320 <br />County Road 10 and 5260 O’Connell Drive, as part of <br />the Coventry Senior Living Development <br /> <br />Introduction: <br />A developer, Coventry Senior Living, plans to construct a 95-unit senior housing building on <br />three parcels, 2320-2340 County Road 10 and 5260 O’Connell Drive. There are several <br />existing easements on two of the parcels. To simplify the easements and since the <br />developer/owner will replat the properties for this development, they are proposing to vacate <br />the existing water main and drainage and utility easements, and would then dedicate one <br />new easement on the final plat that would cover everything needed. <br /> <br />Discussion: <br />The City’s engineer consultant, Bonestroo, and City Staff have reviewed the easement <br />vacation request and have determined that the proposal is acceptable. To vacate an <br />easement or other public interest in a parcel, the City must determine that the easement no <br />longer serves a public purpose. In this case, the developer would dedicate a new easement <br />where the current easements are. This vacation request eliminates the multiple easements <br />and creates one easement in their place. <br /> <br />Recommendation: <br />Open the public hearing and consider comments about this request from staff, the applicant <br />and any affected residents and property owners. Based upon the recommendation of <br />Bonestroo, staff is recommending preliminary approval of the requested vacation subject to <br />the applicant providing Title Insurance for the new easement to be dedicated on the plat. <br />Staff recommends that Council hold off on doing the second reading of the ordinance until <br />the applicant is ready to start construction. This insures that the City will only vacate the <br />easement if the developer/owner constructs the project. <br /> <br />Based on the above information, staff has attached Ordinance 858 that approves the <br />vacation of water main and drainage and utility easements on the properties at 2320 County <br />Road 10 and 5260 O’Connell Drive. <br /> <br /> Heidi Heller <br />Planning Associate <br /> <br />Attachments <br />1.
