pnng <br /> J <br /> Lake Park <br /> 4Iprr laine <br /> 1 \4 <br /> ounds View <br /> FIRE DEPARTMENT <br /> HEADQUARTERS <br /> January 10, 1997 <br /> Mr. Dave Olson <br /> Cross of Glory Church <br /> 5472 Adams Street <br /> Mounds View, MN 55112 <br /> Dear Mr. Olson: <br /> I am in receipt of your letter dated December 30, 1996 addressed to the attention of Ms. Sheldon <br /> regarding a code change with respect to the fire suppression system. <br /> As the local Fire Chief the Uniform Fire Code designates me to act as the final authority in Fire <br /> Code matters. Furthermore, the Code provides that each adopting entity provide an appeals <br /> process subject to appeal by either party to a State Appeals Board. The City has some latitude in <br /> 0 naming this Appeals Board and has designated themselves as the local board. An unacceptable <br /> decision in either parties opinion could be subsequently appealed to the State Board. <br /> The Local Board and Fire Chief are bound in the appeals process to the limits of the Iocally <br /> adopted code. In the case of Fire Detection Systems the code does not provide an exception with <br /> respect to Automatic Fire Suppression Systems thereby placing the Council in a position of <br /> granting a compromise not allowed under the code. While they have the power to take a vote on <br /> this issue it is unlikely that they prefer to and would do so. <br /> I understand from your letter that you are proposing to substitute the detection system for a <br /> suppression system. Since this is not allowed under the code what really needs to be done is <br /> repealing of the sprinkler code. To remove the sprinkler requirement from your signed <br /> construction agreement would require the council to repeal that section of the Fire Code which <br /> adopted the sprinkler ordinance. This would have to be done as provided for in their city charter <br /> and would probably take some time. <br /> It would be best to receive confirmation in writing of your desire to repeal the sprinidering <br /> amendment which should be forwarded as soon as possible and may be done by fax to 786-9617 <br /> with an original to follow. <br /> Please understand there would be another code requirement should you be successful in your <br /> endeavor to repeal the sprinkler code. Since the Church agreed to the requirement it was <br /> . unnecessary to bring this item forward before this, however, should repeal occur the code <br /> provides that a local fire department must have access to all buildings.
