The Minnesota Department of Corrections is one of the agencies <br /> which issues licenses for group homes and group foster homes for the purpose of treating juveniles <br /> who have violated criminal statutes. The rules governing the Department of Corrections define group <br /> homes and group foster homes as providing care for not more than eight children. They will only place <br /> six children in a group home or group foster home unless the local zoning code allows for the <br /> • additional two children. <br /> In 1996, the Mounds View Zoning Code was amended to allow a total of eight children in foster family <br /> homes. This amendment was initiated in response to a request from Mr.Duane Waldoch, who <br /> operates a foster family home for children referred to him by the Department of Corrections. His <br /> license was for six children, and he wanted to obtain a license allowing him to have eight children. <br /> This license could not be issued without the change in our Zoning Code. <br /> Mr. Waldoch applied for the revised license and the Department of Corrections asked us for evidence <br /> that our local Zoning Code allowed eight children. When we sent a copy of the amendment,the <br /> Department of Corrections responded that the way the amendment was written did not permit them to <br /> approve the additional children. Staff is proposing a further amendment which would solve this <br /> problem. <br /> Discussion: <br /> The Zoning Code was amended on July 15, 1996 by Ordinance No. 575. The amendment reads in <br /> part: <br /> Section 1106.02(R-1 District)is amended to read: <br /> 1106.02: Permitted Uses:The following uses are permitted uses are permitted(sic)in an R-1 District: <br /> Subd. 1 Single family detached dwellings. <br /> 41, Subd. 2. Permitted single family uses allowed under Minnesota Statutes 462.357,Subd. 7 as follows: <br />
