Item No. /3 Staff Report No. 6'77-1W/ tiJ5 Meeting Date: 3/3/97 0 Type of Business: Work Session WK: Work Session;PH:Public Hearing; CA:Consent Agenda;CB:Council Business City of Mounds View Staff Report To: Mayor and City Council From: Pamela Sheldon, Community Development Director Item Title/Subject: Wrap Up on Easement for Pedestrian Bridge/Drainage Pond at Highway 10 and Long Lake Road Date of Report: February 28, 1997 Issue: The City has been pursuing acquiring an easement on the northwest corner of Highway 10 and Long Lake Road from Mounds View Square Shopping Center. This easement was needed for the ramp and bridge abutment for the proposed pedestrian bridge at this intersection. At the February 24, 1997 meeting, the City Council voted to stop work on this project. Staff notified Bob Lindahl, in the City Attorney's office, to cease working on the easement. It was Mr. Lindahl's recommendation that the most cost effective approach at this point would be to take the easement, since we now have a signed stipulation from the property owner granting the easement . for$1.00 and there are very few steps left to be done to get the easement. If we do not take the easement, there is a good possibility that the City will be liable for any legal costs that the property owner has incurred. It is Mr. Lindahl's estimate that this cost will exceed the cost of getting the easement. (See attached letter.) Staff wanted to make certain that concluding this process by taking the easement was acceptable to City Council. If the City takes the easement, it would allow work to be done on the drainage pond in the future if we so desired, without going through getting another easement. Recommendation: Direct the City Attorney's office to conclude the process of getting the easement from Mounds View Square Shopping Center. rippoilL TAAAA4--,___, .
