• <br /> EXHIBIT <br /> I' . & . <br /> WALKWAY AND BRIDGE EASEMENT <br /> 111 <br /> This grant of Walkway and Budge Easement is given this day of <br /> 1997, Moundsview Square Associates, LLP, a Minnesota limited liability partnership, formerly <br /> known as Moundsview Square Associates,a Minnesota general partnership consisting of Edward <br /> J. Paster and Jacqueline Paster (hereinafter referred to as "Grantor") to and in favor of the City <br /> of Mounds View, a Minnesota Municipal corporation (hereinafter referred to as "Grantee"). <br /> FOR GOOD AND VALUABLE CONSIDERATION, Grantor and Grantee agree as <br /> follows: <br /> 1. Grant of Walkway and Bridge Easement. Grantor, for itself, its successors and <br /> assigns, hereby grants and conveys to Grantee a perpetual, non-exclusive easement in gross for <br /> walkway, bicycle and pedestrian access, and bridge purposes over, under and across <br /> • That part of the Northeast Quarter of Section 7,Township 30, Range 23,Ramsey County, <br /> Minnesota, lying northeasterly of the northeasterly right of way line of the 225 foot wide <br /> right of way of Trunk Highway 10, as currently established, westerly of the westerly right <br /> of way line of the 66 foot wide right of way of Long Lake Road and southerly of the line <br /> described as follows: <br /> Beginning at the point of Intersection of said northeasterly right of way of Trunk <br /> Highway 10 and said westerly right of way of Long Lake Road; thence northerly along <br /> said westerly right of way line of Long Lake Road for 121.00 feet; thence deflecting to <br /> the left 90 degrees for 87.24 feet; thence southwesterly and perpendicular to said <br /> northeasterly right of way line of Trunk Highway 10 to a point on said right of way line <br /> of Trunk Highway 10 145.00 feet northwesterly of the point of beginning and there <br /> terminating. <br /> (the "Easement Parcel"). Without limiting the foregoing, said easement shall permit Grantee to <br /> construct, maintain, repair, operate and reconstruct a pedestrian walkway, bicycle access and <br /> bridge over and across the Easement Parcel. Without limiting the foregoing, Grantee shall have <br /> the right to alter or to remove the drainage pond currently located on the Easement Parcel.
