Resolution No. 5098 (Option#2) <br /> Planning Case No. 473-97, Oversized Garage CUP <br /> March 24, 1997 <br /> Page 3 <br /> (2) The use will be sufficiently compatible or separated by distance or screening from adjacent <br /> residentially zoned or used land so that existing homes will not be depreciated in value and <br /> there will be no deterrence to development of vacant land. <br /> (3) The structure and site shall have an appearance that will not have an adverse effect upon <br /> adjacent residential properties. <br /> The proposed garage is expected to stand out in contrast to the surrounding homes and <br /> garages. The City has received complaints from neighboring property owners objecting to <br /> this project. A smaller garage, perhaps 28 x 36 feet,would be more readily acceptable. <br /> (4) The use, in the opinion of the City Council, is reasonably related to the overall needs of the <br /> City and to the existing land use. <br /> (5) The use is consistent with the purposes of the Zoning Code and the purposes of the zoning <br /> district in which the applicant intends to locate the proposed use. <br /> (6) The use is not in conflict with the Comprehensive Plan of the City. <br /> Garages are permitted accessory uses in residential areas and allow for the indoor, sheltered <br /> storage of vehicles and other equipment. A larger garage would allow the property owner • <br /> to keep more yard equipment and other things stored inside which would reduce exterior <br /> clutter. A garage of this size, however, in this neighborhood would seem to conflict with <br /> the Comp Plan relating to compatibility with the surrounding area. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br /> recommends approval of the conditional use permit with the following stipulations: <br /> 1. The conditional use permit be recorded with Ramsey County within 60 days of City <br /> Council approval, and a receipt of such recording shall be provided to the City of <br /> Mounds View. <br /> 2. The applicant shall be limited to a garage of no more than 28 feet wide by 36 <br /> feet long(1,008 square feet.) and be restricted to a height of no more than 15 feet. <br /> 3. The garage shall be designed and maintained to provide a uniform building <br /> appearance with the dwelling unit. <br /> 4. The garage shall not be used for living space or other uses not allowed by the <br /> district in which it is located or by the Zoning Code. Notwithstanding allowances in <br /> the Zoning Code, the oversized garage shall not be used for a repair business <br /> whether or not such use would qualify as a home occupation. Should the <br /> 1110 <br /> use change for which the permit was granted, the conditional use permit shall <br /> become null and void. <br />
