ROADWAY EASEMENT • <br /> This Roadway Easement entered into this 1011`day of RP 1 L , 1997, by <br /> Spot's Quick Lube, Inc., a corporation under the laws of Minnesota("Grantor"). <br /> WHEREAS, Grantor is the owner of real property described as <br /> LOT 13,AUDITOR'S SUBDIVISION NO. 89, <br /> RAMSEY COUNTY, STATE OF MINNESOTA <br /> WHEREAS, the City of Mounds View("City") has required as a condition of a <br /> conditional use permit approved by Resolution No.E00-97that Grantor grant to the City a certain <br /> perpetual roadway easement as hereinafter provided. <br /> 11111 <br /> WHEREAS, Norwest Bank Minnesota, N.A., holder of a mortgage encumbering said real <br /> estate, has consented to the conveyance of said easement to the City by a separate consent <br /> agreement which is attached hereto and incorporated herein by reference. <br /> NOW, THEREFORE, for good and valuable consideration, Grantor hereby conveys and <br /> grants unto the City a perpetual, non-exclusive easement for roadway purposes over and across <br /> that portion of Lot 13, Auditor's Subdivision No. 89 which is legally described as follows: <br /> THAT PART OF THE EASTERLY 10.0 FEET OF LOT 13, AUDITORS SUBDIVISION <br /> NO. 89, RAMSEY COUNTY, STATE OF MINNESOTA, WHICH LIES NORTHERLY OF <br /> THE NORTHERLY RIGHT-OF-WAYLINE OF STATE TRUNIHIGHWAY 10 <br /> ! <br />
