City of Mounds View Staff Report <br /> Ordinance 595:Day Care Centers <br /> April 2, 1997 <br /> Page 2 <br /> • the Highway gh ay 10 right-of-way line, shall not be considered a non-conforming use, and any structure or <br /> play yard on the premises may be reconstructed, expanded or enlarged as long as the setback of the <br /> play yard from the Highway 10 right-of-way line is not made less by the reconstruction, expansion or <br /> enlargement" This revision would allow Kindercare to continue operating without becoming a non- <br /> conforming use. <br /> Background: <br /> At present, day care centers and group nurseries are allowed only in the residential districts. At your <br /> meeting on February 24,two issues were raised by Councilmembers. These issues were: <br /> ■ If day care centers are placed in business and industrial districts, it is possible the they will be <br /> located next to streets which carry higher volumes of traffic, and children will be subjected to <br /> higher levels of exhaust fumes. The question was asked whether a criteria should be added <br /> which would address this possibility. <br /> • The question was asked whether there should be a distance requirement between day care <br /> centers and group nurseries and businesses serving liquor, liquor stores and adu b <br /> establishments. <br /> • City Council referred the ordinance revision back to Planning Commission for more discussion of-these <br /> issues. At your meeting on March 24, Staff provided information on ways to address the issues and the <br /> recommendation from the Planning Commission. Three options were discussed. <br /> #1: Add day care centers and group nurseries to the business and industrial districts as conditional <br /> uses. Criteria a through g.noted above would apply to these uses in the residential districts. <br /> Criteria a. through i. would apply in the business and industrial districts. <br /> #2: Add day care centers and group nurseries to the business and industrial districts as conditional <br /> uses. Criteria a. through i. would apply to these uses in all districts where they were allowed <br /> (residential, business and industrial). Provision would be made for existing day care centers so <br /> they did not become non-conforming if they did not meet the two new criteria(h. and i.). <br /> #3: Adopt the ordinance as originally proposed, i.e. add day care centers and group nurseries to the <br /> business and industrial districts as conditional uses without adding any new criteria <br /> After discussion, City Council introduced an ordinance revision which would enact Option#2 for first <br /> reading.
