The <br /> building is a fourplex which is currently occupied by two families. The other two units have been <br /> placarded by Rick Jarson, Building Official, preventing occupancy due to the condition of the <br /> units and common areas. <br /> Staff has continuously worked with the owners, Legal Aid, a court appointed administrator and <br /> the tenants to attempt to bring this building up to Building and Housing Code standards since <br /> December of 1995. Because of the continued hazardous condition of the property (see attached <br /> Housing Inspection Report Form) and the lack of response from the owner, staff consulted with <br /> Attorney Bob Long as to possible remedies. He proposed issuing an Order of Abatement for the <br /> demolition of the property under Section 463.161 of the Minnesota Statutes. Staff has prepared <br /> Resolution No. 5316 for this purpose. <br /> If City Council approves the resolution and authorizes the Order of Abatement, the owner has 20 <br /> days to remove or raze the building or reply to the order. If the owner does not comply with the <br /> Order, the City of Mounds View will file a motion for summary enforcement of this Order with <br /> the Ramsey County District Court. If the District Court authorizes the Abatement Order, the City <br /> will raze the building and all necessary costs incurred by the City in the corrective action will be <br /> assessed against the property. <br /> Background: <br /> City Civil Case <br /> In December, 1995, staff received a complaint from a tenant living at 2091 Hillview Road <br /> indicating several code violations. An inspection was conducted and a list of violations was sent <br /> to the owner, Soji Agboola, giving him 30 days to correct them. After several attempts to <br /> reinspect the property, an Administrative Offense and a Court Citation were issued. A court date <br /> was scheduled for April 9, 1996; the owner did not appear in court. A warrant was issued. <br />
