EASEMENT GRANT <br /> • <br /> THIS EASEMENT GRANT IS MADE THIS day of 1997, <br /> between MSP Real Estate, Inc., a corporation under the laws of the State of Minnesota, having its <br /> principal office located at 311 fifth Avenue North, Minneapolis, Minnesota, 55401, (hereinafter <br /> referred to as "Grantor"), and the City of Mounds View, a municipal corporation organized under <br /> the laws of the State of lVfinnesota, having its principal office located at 2401 highway 10, Mounds <br /> View, Minnesota, 55112, (hereinafter referred to as"City"). <br /> The following recitals of fact are a material part of this instrument: <br /> A. The Grantors are the owners of a tract of land described as follows and hereafter <br /> referred to as the"Property": <br /> Real estate situated in the County of Ramsey, State of Minnesota described on the <br /> attached Exhibit A, incorporated herein by this reference. <br /> B. The Grantors wish to grant and the City wishes to receive an easement over, under • <br /> and across that part of the Property described as follows and hereafter referred to as"the Easement <br /> Premises": <br /> A perpetual easement for utility and drainage purposes over, under and across the real <br /> estate situated upon the Property as more fully described on the attached Exhibit B, <br /> incorporated herein by this reference. <br /> NOW THEREFOR, for valuable consideration, the receipt and sufficiency of which is hereby <br /> acknowledged, the following grants, agreements, and covenants and restrictions are made: <br /> 1. GRANT OF EASEMENT. The Grantors hereby grant to the City, its successors and <br /> assigns, a perpetual easement for utility and drainage purposes over, under and across the Easement <br /> Premises. <br /> 2. USE OF EASEMENT PREMISES. The installation or maintenance by the City of <br /> pipes, conduits, or wires, under, upon or over the Easement Premises is permissible. Non-exclusive <br /> use of the Easement Premises is hereby granted to City for public utility and drainage purposes over, <br />
