EASEMENT GRANT • THIS EASEMENT GRANT IS MADE THIS day of 1997, between MSP Real Estate, Inc., a corporation under the laws of the State of Minnesota, having its principal office located at 311 fifth Avenue North, Minneapolis, Minnesota, 55401, (hereinafter referred to as "Grantor"), and the City of Mounds View, a municipal corporation organized under the laws of the State of lVfinnesota, having its principal office located at 2401 highway 10, Mounds View, Minnesota, 55112, (hereinafter referred to as"City"). The following recitals of fact are a material part of this instrument: A. The Grantors are the owners of a tract of land described as follows and hereafter referred to as the"Property": Real estate situated in the County of Ramsey, State of Minnesota described on the attached Exhibit A, incorporated herein by this reference. B. The Grantors wish to grant and the City wishes to receive an easement over, under • and across that part of the Property described as follows and hereafter referred to as"the Easement Premises": A perpetual easement for utility and drainage purposes over, under and across the real estate situated upon the Property as more fully described on the attached Exhibit B, incorporated herein by this reference. NOW THEREFOR, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the following grants, agreements, and covenants and restrictions are made: 1. GRANT OF EASEMENT. The Grantors hereby grant to the City, its successors and assigns, a perpetual easement for utility and drainage purposes over, under and across the Easement Premises. 2. USE OF EASEMENT PREMISES. The installation or maintenance by the City of pipes, conduits, or wires, under, upon or over the Easement Premises is permissible.
