? 10. <br /> REQUEST FOR COUNCIL CONSIDERATION Agenda Section: <br /> DUNES <br /> MY <br /> STAFF REPORT Report Number: 94-1230WS <br /> AGENDA SESSION DATE <br /> July 5, 1994 Report Date: 6-30-94 <br /> DISPOSITION <br /> Item Description: Discussion of Request for Extension of Conditional Use Permit, Church Upon <br /> the Rock <br /> Administrator's Review/Recommendation: <br /> - No comments to supplement this report -410, <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> [IMMARY; <br /> Church Upon the Rock, 7901 Red Oak Drive, has made application for an extension of a Conditional Use <br /> Permit to allow for the continued use of a temporary accessory structure on residentially zoned property. <br /> The applicant was originally granted a Conditional Use Permit for the accessory structure by the City <br /> Council. Passed in 1988, City Council Resolution No. 2320 contained a "sunset" clause which effectively <br /> revoked the permit after a five year period. Last year (1993), the City Council granted a one-year <br /> extension to the C.U.P. The attached letter more fully explains the applicants current request. <br /> For review: <br /> In 1988, the Planning Commission and the City Council gave approval for the location of a temporary <br /> accessory building at 7901 Red Oak Drive (Resolution No. 2320). At the time of approval, both the <br /> Commission and the Council had concerns about the available off-street parking area on the site, the lack <br /> of an improved surface for those existing parking facilities and, the proposed use for the accessory building. <br /> In order to somewhat address those concerns, the approval for the temporary structure included the <br /> aforementioned sunset clause. The specific language of the Resolution stipulated that the temporary <br /> structure he removed after a five year period and replaced with a permanent building. Additionally, at the <br /> end of this five year period, the site (i.e. parking facilities and surface) were required to be upgraded to <br /> meet current City codes. The concern with the use of the building was addressed in a separate resolution. <br /> In September of 1993, the City Council adopted Resolution No. 4409 which, in part, extended the <br /> Conditional Use Permit to July 1, 1994. <br /> At this time, the applicant is requesting that an additional extension of two (2) years be granted to allow <br /> more time for the Church to assess its needs and options in relation to the site. The Mounds View <br /> Planning Commission has reviewed the request and is tentatively scheduled to take formal action on the <br /> request at their July 6, 1994 meeting. <br /> I have provided all other materials received as a part of this request in addition to all documents referenced <br /> in this memorandum. <br /> f e <br /> Poul Harrin ton Community D elopment Coordinator <br /> RECOMMWN1 ATION: <br /> Staff seeks Council direction on this matter. <br />
