Any police officer or Community Service Officer of the <br /> Municipality shall take up and impound any dog found in violation <br /> of this subdivision and release it only upon the payment of fees <br /> as provided for in this Chapter. <br /> Subd. 12 . Muzzling: Whenever the prevalence of hydrophobia or <br /> rabies renders such action necessary, to protect the public <br /> health, safety and welfare, the Mayor shall issue a proclamation <br /> ordering every person owning or keeping a dog to confine it <br /> securely on his premises unless it is muzzled so that it cannot <br /> bite. No person shall violate such proclamation, and any <br /> unmuzzled dog running at large during the time fixed in the <br /> proclamation shall , if possible, be picked up and impounded or, <br /> if necessary, killed by the police officers without notice to the <br /> owner of said dog pursuant to Minnesota Statutes section 35 . 69 . <br /> Subd. 13 . Clean Up: Any person who owns, harbors or keeps a dog <br /> within the City shall clean up all feces of the dog and dispose <br /> of such feces in a sanitary manner. <br /> Subd. 14 . Interference with Officers: It shall be unlawful for <br /> any unauthorized person to break open the Pound or to attempt to <br /> do so or to take or let out any dogs therefrom or to take from <br /> any police officer or Community Service Officer any dog taken up <br /> by him in compliance with this Chapter or in any manner to <br /> interfere with or hinder such officer or Community Service <br /> Officer in the discharge of his duties under this Chapter. <br /> Subd. 15 . Kennels: <br /> a . Conformance with Provisions: <br /> (1) Residential : Any premises where more than two (2) dogs but <br /> not more than four (4) dogs over six (6) months of age are owned, <br /> boarded, bred or offered for sale2. <br /> (2) Commercial : Any premises where more than four (4) dogs over <br /> six ( 6) months of age are owned, boarded, bred or offered for <br /> sale. <br /> b. Licensing Requirements: All dog kennels, residential or <br /> commercial , as defined in subdivision 1 of this Section, must be <br /> established by a special use permit as required in Title 1100 of <br /> this Code . The zoning classifications as required under Chapter <br /> 1103 and Section 1104 . 02 of this Code must be conformed with. <br /> Notwithstanding any provision to the contrary in Title 1100 of <br /> this Code, the owner of a proposed dog kennel shall present a <br /> petition to the Council signed by over fifty percent (50%) of all <br /> 1 .
