Chapter 1106 .04, Subdivision 6 allows for garages in <br /> residential areas of the City in excess of 864 square feet, but not <br /> exceeding 1264 square feet, with the issuance of a Conditional Use <br /> Permit. The applicants request, as proposed, meets all other <br /> requirements of the Municipal Code relating to setbacks, height, land <br /> use, etc. <br /> At the time the applicant made application for the Conditional Use <br /> Permit, fees for the building permit required for constructing the <br /> garage were also accepted. Because these fees had been paid, the <br /> applicant went ahead with the construction of the garage - not knowing <br /> that the Conditional Use permit procedure needed to run its course prior <br /> to construction. Staff feels that the applicant made an honest mistake <br /> and does not recommend any penalty in the form of increased fees. <br /> I have included an area map, application and plot plan provided by the <br /> applicant for your review.
