AGREEMENT <br /> This Agreement is made and entered by and between the City of • <br /> a Minnesota Municipal Corporation (the "City") , and an <br /> Employee of City, (the "Employee") . <br /> RECITALS <br /> WHEREAS, the State of Minnesota has entered into a contract with U.S. <br /> West Corporation for the purchase and airtime of cellular telephone <br /> equipment; and <br /> WHEREAS, the City, as a political subdivision of the State of <br /> Minnesota, has elected to make cellular telephones and applicable <br /> rates available to City Employees for personal use at the contract <br /> prices; and <br /> WHEREAS, the Employee will sign a service agreement with U.S. West <br /> and, pursuant to said agreement, U.S. West will bill Employees <br /> directly and receive direct payment from Employees for the use of said <br /> cellular telephones; and <br /> WHEREAS, pursuant to said terms of agreement, if any such Employee <br /> defaults on payment of such charges to U. S. West, U.S. West may <br /> recover all such amounts due directly from the City; and <br /> WHEREAS, the Employee desires to make use of a cellular telephone <br /> under the terms and conditions offered by U. S. West; and • <br /> WHEREAS, the City is willing to allow the Employee to make use of the <br /> cellular telephone and applicable rates, under the terms and <br /> conditions stated herein, <br /> THEREFORE, in consideration of the mutual covenants herein contained, <br /> and for other valuable consideration, the receipt and sufficiency <br /> which are hereby acknowledged by both parties, the parties agree as <br /> follows : <br /> 1 . The City grants the Employee the right to use a cellular <br /> telephone under the discounted terms offered by U.S. West. <br /> 2 . The Employee agrees to pay all charges in connection with <br /> the use and maintenance of said cellular telephone directly <br /> to U. S . West or such other person specified by U.S. West to <br /> receive such payment, within any time period specified by <br /> U. S . West or its authorized agent or assignee. <br /> 3 . In the event an Employee fails to make payment in a timely <br /> manner, so that the City receives notice from U.S. West of <br /> its intent to collect such charges from the City, the <br /> Employee hereby authorizes the City to deduct from the <br /> Employee' s paycheck, all sums necessary to pay the amount <br /> specified as owing to U. S. West, its agent, or assignee, • <br /> together with a twenty-five dollar ($25 . 00) administrative <br /> fee to cover the charges incurred by the City in processing <br /> this payroll deduction request. Such payroll deductions may <br /> continue until all amounts owing, together with all other <br /> administrative fees, are paid in full. <br />
