J <br /> ORDINANCE NO. 94- <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> AN ORDINANCE RELATING TO PUBLIC HEALTH, SAFETY <br /> AND WELFARE, REQUIRING ALL CONTIGUOUSLY OWNED <br /> UNPLATTED PROPERTY TO BE INCLUDED IN ALL <br /> SUBDIVISIONS, ADDING A DEFINITION OF OUTLOT AND <br /> AMENDING TITLE 1100, CHAPTER 1102, SECTION 1102.02 <br /> AND TITLE 1200, CHAPTER 1202, SECTION 1202.02, <br /> SUBDIVISION 2 OF THE MOUNDS VIEW CITY CODE <br /> THE CITY OF MOUNDS VIEW ORDAINS: <br /> Section 1. Findings. The City Council finds that it is in the best interest of <br /> the public to require subdividers and owners of property to include all contiguously <br /> owned property when submitting a plat application for property that is previously <br /> unplatted. This requirement is necessary in order for the City to properly plan for <br /> the orderly development of property within its boundaries and to ensure that <br /> subdividers consider the effect that present development has on potential future <br /> development of adjoining properties. <br /> Sec. 2. Section 1202.02, Subdivision 2, of the Mounds View City Code is <br /> amended by adding the following paragraph: <br /> c. The application must include all contiguous land <br /> owned by the subdivider or owner, unless the <br /> application is a replat of property that has been <br /> previously platted. If only a portion of the <br /> property to be subdivided is planned to be <br /> presently developed, the remainder of the land may <br /> be platted as an outlot. The subdivider or owner <br /> must submit a schematic demonstrating how the <br /> property that is not currently planned for <br /> development could be developed consistent with the <br /> City's regulations. <br /> Sec. 3. 4The introductory clause to Section 1102.02 of the Mounds View City <br /> Code is amended to read as follows: <br /> DEFINITIONS: The following words and terms, wherever <br /> they occur in this ale Code, shall be defined as follows: <br /> Sec. 4. Section 1102.02 of the Mounds View City Code is amended by adding <br /> a new subdivision to read: <br /> Subd. 81a. OUTLOT. A parcel of land included in a plat <br /> or subdivision which is: (1) smaller than the minimum lot <br /> size and therefore unbuildable until combined through <br /> platting or subdivision with additional land; (2) not <br /> presently proposed for development and therefore subject <br /> JJT72746 <br /> MU125-14 <br />
