RESOLUTION NO. <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION DIRECTING THE CITY CLERK NOT TO FILE <br /> CHARTER AMENDMENT CONCERNING TERM LIMITS <br /> WHEREAS, at the November 8, 1994 election, a ballot proposition pertain ng <br /> to limiting the number of terms that the mayor and city council members may hold was <br /> adopted by the voters; <br /> WHEREAS, the Minnesota Attorney General has concluded that a term limits <br /> provision such as the one adopted at the November 8, 1994 election violates the <br /> Minnesota Constitution; <br /> WHEREAS, a case involving the City of Minneapolis is currently pending <br /> before the Minnesota Supreme Court that will address the constitutionality of term <br /> limits; <br /> WHEREAS, Minnesota Statutes, Section 410.11 requires the city clerk to file <br /> a copy of the charter amendment with the Secretary of State and County Recorder; <br /> WHEREAS, the city council must provide for the orderly administration of <br /> justice and insure that the Mounds View City Charter does not contain any <br /> unconstitutional provisions; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE MOUNDS VIEW CITY COUNCIL <br /> that the city clerk is directed not to file the charter amendment that was passed on <br /> November 8, 1994 until the Supreme Court has issued a final ruling as to the <br /> constitutionality of term limits in the case that is presently pending before it <br /> involving the City of Minneapolis. <br /> Jerry Linke, Mayor <br /> (ATTEST) <br /> (SEAL) Samantha Orduno, City Administrator <br /> 170179264 <br /> 1413I.25-11 <br /> t'Ib 39Vd 0I EBLEEZ E 9'Q I W5A'd2[9 V S3W'IOH°W02I3 L I 'S I 66-0 t-l1ON <br />
