RESOLUTION NO. 4671 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING A WETLAND ALTERATION PERMIT AND VARIANCE <br /> FOR LOUIS DOWNING TO ALLOW CONSTRUCTION OF A SINGLE FAMILY HOME <br /> ON LOT 2 BLOCK 1 DOWNING ADDITION, PLANNING CASE NO. 401-94 <br /> WHEREAS, the Mounds View City Council has reviewed the <br /> request of Louis Downing for -a---variance- to construct a- single <br /> family home on his property which is located in a wetland buffer <br /> zone; and <br /> WHEREAS, Chapter 1010.07, Subdivision 3 a (3) of the <br /> Mounds View Municipal Code requires that all buildings, other than <br /> accessory buildings, as defined in Title 1100 of this Code, shall <br /> be set back at least one hundred feet (100' ) from the wetland; and <br /> WHEREAS, Louis Downing has made application to allow the <br /> construction of a single family home within one hundred feet (100' ) <br /> of the wetland on the property legally described as Lot 2, Block 1 <br /> Downing Addition; and <br /> WHEREAS, the proposed location of the home on the <br /> property meets all other zoning setback requirements as stipulated <br /> by the Municipal Code; and <br /> WHEREAS, the City Consulting Engineer has reviewed the <br /> request for compliance with established Municipal Codes and has <br /> concluded that construction of the single family home on the <br /> property will not have a substantially or significantly adverse <br /> effect upon the ecological and hydrological characteristics of the <br /> wetland. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View City <br /> Council approves a variance to allow the construction of a single <br /> family home in a Wetland Buffer Zone on the property legally known <br /> as Lot 2 , Block 1 Downing Addition contingent upon the following: <br /> 1) The applicant shall prepare and submit to the City <br /> Consulting Engineer for review and approval, a surface water <br /> drainage and erosion control plan of the subject property based on <br /> a site survey. <br /> 2) The applicant shall submit the plan to the Rice Creek <br /> Watershed District or the appropriate Local Government Unit (LGU) <br /> to ensure compliance with provisions of the Wetland Conservation <br /> Act (WCA) . <br /> 3) The applicant shall be responsible for the restoration of <br />
